So if a company receives 100 applications from white men for a job but only 10 from women or some minority, who has the better odds of getting hired? Not the white guys. Diversity is only a euphemism for “less white men.” I am the mother of two future white men and I worry for them since their “ethnic group” is so often portrayed as the villains of society.

Yes…now you have an idea of what is was like for women and people of color/diverse ethnic background for the 200 years before affirmative action, and programs that corrected centuries of discrimination.
I’m so sick of everything having to be FAIR. Life isn’t fair. Accept it and move on. Let businesses hire who they want. If they think hiring old gay mormon black women is best for the company, that’s cool. It’s their decision. If a company’s hiring practices upset people, they’ll show their displeasure with their wallets and the company will be forced to re-think things. Until then, leave companies alone. Consumers and the free market will handle things much better than a poorly run government agency.

The law that was applied to Walmart was Title VII of the Civil Rights Act that is applied on a federal level to companies with 15 or more employees.Some individual statews may have stricter laws than the Federal Law, buat all states as a minimum are subject to Title VII. This law does not allow discrimination of employees based on their race, color, religion, sex, or national origin. The Equal Pay Act of 1964 may have also been applied. The only exception of discrimination in the workplace would be if there was a Bona Fide Occupational Qualification (BFOQ). Race is never a BFOQ. An example of a BFOQ is an advertiser could advertise for only teenage girls if the ad dealt with teen swim wear. Obviously the warehouse would not qualify as women are just as qualified as men as long as they can meet the reasonable qualifications of the job. Before this ever reached the lawsuit stage Walmart had an opportunity to settle this situation with the Equal Employment Opportunity Commission (EEOC). Walmart chose not to settle until after a lawsuit was filed. It looks like Walmart was caught and hopefully they will do a better job in the future to prevent discrimination. Several other companies have settled similar lawsuits, and without a doubt there will be more settlements in the future.
