Real “malpractice” is rare. Read the definition. Just because there’s a bad outcome doesn’t mean it’s malpractice. Nothing comes with a 100% guarantee in life, particularly messing with a human body. I’d like to see the playing field leveled so doctors who are accused of malpractice and are exhonerated can be awarded damages automatically when the plaintiff loses. Then, lawyers will think twice about taking a shot at the doctors. In addition, these cases should be heard by medical professionals, not the general public with bleeding hearts. (no pun)
when lawers get more than their clients something is wrong with the system. They need to be forced to do away with contigent fee’s and charge hourly rates.
When the awards get out of hand and into the millions (perhaps including punative), the response is immediately to look at the poor suffering claimant. How about looking at the poor suffering taxpayers who are paying for it in taxes and in costs of medical services and insurance. And many of them are losing their homes in the bargain.
