    I would also mention that it was expected that there would be an increase in lawsuits this year because of the economy. Down turn in the economy means more “frivilous” lawsuits. Right? Wrong. The National Law Journal reported that the number of lawsuits have actually declined this year. Those of us that actually practice in this field know the realities. And by the way, I have had experience with the NICB and any Tom, Dick or Harry can submit a “suspicious” claim to the NICB and it means absolutely nothing.

    How does the number of lawsuits going down indicate that fewer frivolous lawsuits and claims are being filed? There is no relationship between the two “facts”.

    after I was slightly injured on the jobs. Just up and told the WC carrier to deny the claim for the hospital Emergency Department bill. Said the incident did not happen, had no knowledge. So to try to save a few bucks on the renewal work comp. premium, the employer lied! Whatta world.

    As a fraud investigator, I am here to tell you that even though claims are down, lawsuits are down, fraud is most defenitely on the rise. Case counts for fraud investigators are up all over the country and it’s not because adjusters are simply referring more cases over. There is unfortunately just more fraud across all lines.
