Cindy is correct when she points out the fact that there are mold (mould) claims in Europe, and that they have been around for a number of years. The difference is that the vast majority of claims are for remedial structure works, which can be substantial for dry-rot infestations. We have very few claims (upheld) for injury to health as a direct result of mold. We do have some claims resulting from the generally unhealthy nature of a damp environment, especially in rented accommodation etc. The toxic effects of certain types of mold (as is the case in the US) are very rarely cited as a basis for the claim. When it is, it is usually because the claimant has an allergy to fungal spores, not because the spores and/or expirations of the fungus are in themselves toxic (regardless of any specific allergenic reaction).

Does anyone know what you can do if you’re a renter and have mold growing in your apartment and your in a lease? This is in CA. In case that makes a difference.

    Thanks,

DC — are you employed by the insurance industry?

It may be true that those who are harmed are small in number, but believe me, they are destroyed physically, fiancially, and emotionally. To blame the victims or the trial lawyers is ludicrous. WHY don’t you blame the REAL culprits — homebuilders and commercial builders who can’t or won’t build buildings to keep the rain out?

Leaky roofs, siding, windows, and foundations as well as the use of defective materials and materials that are not installed according to manufacturers recommendations are the cause of toxic mold in homes and the work place. But guess what — insurance companies keep selling insurance to these bad contractors and then blame victims and trial attorney’s when lawsuits are filed.

AND — this will never harm the insurance industry — they have just excluded mold from coverage. In fact they either exclude most things from coverage or stonewall on claims to the point that I find it disgusting that I have to buy insurance. Do you know ANYTHING else in this country that nearly EVERY citizen HAS to purchase but doesn’t dare use for fear of cancellation?

FYI: If you check the end of the year SEC filings of major insurance companies you will find that their earnings last year were near a record. May have been a record. They raise rates claiming they are losing money due to mold claims, but the SEC filings prove this simply isn’t true.
