I doubt liability *should* attach, but I bet a jury will return a verdict in his favor since he is paralyzed. The problem is that the jury will *WANT* to rule in his favor. It’s just a guess, but I’d probably settle if I could get something relatively low.
If the jury comes back saying they should’ve tied them down, Menards is hurting.
