So I wake up and there is a burglar in my home. He sees me and immediately tries to flee, I can now shoot him in the back as he goes out my window?

If you are still dumb enough to try to break into someone’s home and steal their possessions (along with their sense of security), then yes, it is ok to shoot you. However, the person must reasonably believe that the force was necessary to prevent
imminent death or great bodily harm to himself or herself or to another person. A shot in the back is not likely going to meet that. However, this should stop the lawsuits for wrongful death against a homeowner who is protecting his family. If I saw an intruder going into my daughter’s room, I would shoot him in the back and have not an ounce of remorse. Now, his family won’t be able to sue and win – and they will have to pay my legal fees, lost income and other expenses as a result. I’m ok with not protecting criminals anymore.

Our legal system, designed by lawyers, for lawyers, and managed by lawyers is a joke. It is unconscionable for anyone to get $150,000 for a $5,000 property claim. It defies logic and any test of reasonableness. It is impossible to have incurred that much legal time to assert the claim for unauthorized repairs and somebody with an ounce of common sense should have known that and rejected this clown’s “fees”. The economy is in the toilet, people are out of work and struggling, and this moron gets $150,000. Now that’s justice.
