The defense argument that the resulting condition is ‘unique’ should by itself have resulted in a finding for the Plaintiff – in that as consumers the home is clearly not what they could have reasonably anticipated when they signed the purchase contract. Don’t know if the decision was based on technicalities not mentioned in the article… or poor lawyering… or ??? Sounds like this is ripe for an appeal.
