If more courts rule this way it could really open up a lot more claims. Cancer is so prevelant and comes with a lot of emotional distress for families. It also depends heavily on where the claim is filed. (see http://www.equotemd.com/blog ). There is a very wide range of claims for medical malpractice insurance companies based on what county the claim is filed in. I am curious how other supreme courts have ruled on these kinds of cases. Anyone know?
