2 Missouri Employers Jailed for Noncompliance With OSHA Citations

    What kind of fines can be imposed on an employee who fails to follow the compliance instructions of their employer?

    Can’t Fire them they will sue for wrongful termination

    If they get injured because they failed to follow the rules, they get workers comp, can’t fire them because they hurt themselves and are collecting, they will sue.

    If they die because they failed to follow the rules, their family sues because even though the OSHA guidelines wer put into place, they were not followed by the employee and the employer should have made sure that they did blah blah blah.

    Why do you think you can’t fire them? You absolutely can fire an employee for not following safety rules. Problem is most employers do a horrible job of documenting this, and following progressive discipline policies, which leads to them getting sued. If done correctly, there is no issue with firing an employee who repeatedly does not follow safety rules.

    You’re missing the point, the EMPLOYERS were not following OSHA. That’s why they were fined. Had nothing to do with employees.

    Good for that court system!! I have seen to many cases where OSHA regulations were not followed thus people got hurt. In these times Employers think that they can do whatever they want because they KNOW they have their employees over a barrel, and if they don’t like what’s going on there are at least 10 others who will and can take their place.

    As far as Employees not following safety rules… That’s is one of the easiest ways to fire people, but, as Bob said, failure to properly document these things always gets in the way.

    As a workers comp. provider, I am happy to see this action. What else can OSHA do? I wonder how may insurance applications these dirt bags did not fill out correctly. Re other posts here, this has nothing to do with employees not following OSHA standards. The employers must first communicate OSHA rules to the employees. These guys were not doing that. I hope they enjoy their time in the slammer and decide to find another line of work when they get out.
