If this guy was convicted after a thorough investigation and available technology at the time, there was no negilgence on the part of the police/prosecutor. Just because “new technology” is introduced after the fact, you can’t retroactively consider negligence.
The D.A., from what I recall, “persuaded” the 6 year old key witness in this case; when she was older she basically asserted that her testimony was coerced by the prosecutors, that she was goaded into saying that it was her uncle (Elkins)that committed the crime. After learning about this case I definitely walked away with the feeling that the investigators involved gave themselves tunnel vision on Elkins; they didn’t want to look into other options because they had an answer they felt fit so they called it “case closed” without the full scope of an investigation as would have been conducted if they had started with a clean slate, no suspects that they felt were “good for the crime.”
It’s very scary to think our “Justice System” can do this to an innocent man with all the new technology available today. It goes to show they don’t really care about anyone’s life.
