Can anyone tell me where in the Constitution, the Federal Govt has the authority to dictate & regulate this matter? I always have trouble finding that “Penumbra” section which is somewhere between the “Good & Plenty” clause and the “Seperation of Church and State” mandate!
Actually, the regulation of commerce is in the constitution. And in several amendments and supporting court ruling. Now just because Thomas Jefferson did not write it in the original edition of the constitution does not mean that any subsequent amendments etc are not valid. the FCC has a broad mandate to regulate commerce, and that is not in dispute; what folks get all up about is their perception that individual rulings etc. are not to their liking but arguing about that won’t get them anywhere so they attack at the highest level, the constitution, but not realizing that the constitution was the BEGINNING not the end of the process of setting up our system of government. So lots of things were not mentioned in the constitution but they didn’t have email or internet or broadband, and employers could act as if they answered to no one, but things changed and that is a fact of life itself. So employers cannot discriminate for any reason. If you think it was a bad thing, just imagine how you’d feel if it happened to you.
