    Okay, I work in workers’ comp lines only, but what you’re referencing would be a valid argument if we’re discussing statistical figures such as what reflects on other lines of insurance like auto, home or life/health. This situation, while tragic, is different. I’m not disputing the victim and her parents most likely are of African American descent, as am I; the choice of words Ally used to perhaps bring a little levity to the thread was rather lop-sided; usually such comments are aimed at the perpetrators of things like this, not the victims! Remember the story about the guys in the W. Virgina county who tried to stage an auto accident with a tow chain still hooked up to the front bumper of the “wrecked” car? We all had a field day poking fun at those idiots, because they were the PERPETRATORS, not victims.

    I am so “sick and tired” of insurance companies paying these types of claims! All this does is spread the word that” you can get something, like $$$$$, by suing no matter what happened if you play the “race” card! I am so tired of the “race” card used by every conceivable “claimant”. An example: “the adjustor denied my claim because I am Hispanic, Black, Chineses, etc”!!!!!!
    no, the adjustor denied your claim because you had no coverage!!!!

    These claims are paid because if they are not the insurance company gets sued for bad faith. If state court judges and legislators would reel in bad faith claims against carriers, then there would be safer to take these to trial and get the true value from a jury. Unfortunately, if the trial goes badly and the award is greater than the policy limits, the insurance company then gets sued for not settling. It is “Catch 22.”

    It would have been nice if the article added that the case against First Student bus company was tossed by the judge. The school district was also dismissed. The only two defendants left on the civil case were the two murderers and since they’re in jail, the civil case died.
