Kansas Lawsuit Over Fatal Team Bus Accident Remains Uncertain

    The plaintiffs will probably be awarded millions, but I hope they won’t be. We should not be rewarding stupidity. If somebody can’t figure out that riding on top of a moving bus is a stupid idea and could get them killed by the time they reach college then they deserve the Darwin Award. I hope her child grows up smarter than its father.

    Stay away from the buses roof. It’s not the place to play. The bus goes fast, and knocks off your as* And you might die on that day. Olay! Everybody now.

    This is not as dumb as many cases we have seen; the bus was modified to sit on top of it. You can google it and find a photo of it.

    It is up to the driver to enforce the rules if sitting up there while the bus was moving is prohibited. The bus company will likely to be found partially at fault if it goes to trial.

    The 43 year old driver was operating with a DUI restricted license that prohibited him from driving a commercial vehicle. While his driving wasn’t a factor, it will inflame the liability argument. The bus accomodated 71 people but there were only 16 inside. The idiots apparently rode atop. Why anyone would put seats atop a bus is baffling. The seats probably faced forward suggesting those killed/injured were not paying attention when this happened. Unfortunately, in our flawed society and legal system that promotes the notion “somebody must pay regardless of liability”, there will be a settlement. On any liability argument, the proximate cause here is not the un-licensed driver, and not the lack of a warning not to sit atop a moving freaking bus, but personal stupidity and carelessness. Had these idiots been paying attention, they too could have ducked. The dead guy was 27 years old. There are no excuses for his stupidity. Had he been seated and looking forward, he’d be alive today.

    I probably can safely assume that alcohol was also a factor in the accident.

    Yeah, but it was probably the “richard-heads” riding atop the bus. What was the last thing going through the dead guys mind when the accident occured? An overpass.
