    If you read carefully, she did not participate in the “plunge.”

    Just to quote the story:

    Hottenstein did not participate in the afternoon plunge that Saturday, but stayed in the resort community that night with friends. She was last seen leaving a restaurant with a friend around 2:15 a.m. Sunday, and her body was found by a passer-by about five hours later, not far from the restaurant.

    Only 19 defendants? Surely they could have found more people to sue. Their lawyers are slacking!

    Sounds like she was overserved by businesses owned by her own family! THEN she had the clear-headed idea to jump into frigid water. My God can we have “loser pays” civil tort system at some point??

    Realist, I think you may have misread… Her parents didnt own the bars, they meant that among the 19 that her parents are suing “are the owners of the two bars” but I do agree with you, why cant some people just realize that she made her own decisions to drink a ton of alcohol on her own free will and the bars didnt force feed her. If she went for a swim after it is her own fault.
    I am so sick of all these lawsuits trying to force responsibility on someone else. And people wonder why they pay so much for insurance…

    I like Ha!’s comment..they couldn’t find any more defendants? The bottom scratching, slime ball attaorneys surely are not trying very hard.

    Yep. And I think NJ is a pure comparative negligence state. Therefore her own intoxication should be comparative (and if over 50%, no recovery). No idea if dram shop liability is the law (and thats one that makes little sense to anyone…suing for overserving…). She knew how much she was drinking and had to drink. Sad story but is it anyone else’s fault???
