I wonder how long it is going to take before we have no more corporations or people to sue. I guess the lawyers will have to start looking abroad. This country is going bankrupt fast. It’s like a feeding frenzy.
I’m going to sue my local diner because I like the red eye biscuits and gravy I now weigh 350 pounds – anyone want my case? It’s just as riduculous as this one!
This is absolutely ridiculous. It is sad that someone died, but…if she had the “fire safe” cigarettes that the suit alleges were available at the time, she probably would be suing the lighter company for starting the fire.
Hey…. Can we counter-sue people who make idiotic claims, and costs us taxpayers and consumers, who have to pay the expenses of having courts, and increase in price of goods to cover the increasing premiums that go to protect product mfrs. from ridiculous claims? maybe, we should also sue for brain damage that we suffer when we read the ridiculous Complaints drafted by warp-minded attorneys. If their claims are valid, so is ours.
We have consensus. Both the plaintiff and her scumbag lawyer are fools. I’d bet we can add the judge to that list when he refuses to let the tobacco company out of the suit. But there’s an upside…..at least the decedant can’t be another member of a class lawsuit for lung cancer.
I FEEL FOR THE MOTHER, BUT i’m embarrased to say that i live about 30 minutes away from this idiot. hmmm…she smoked. WHO LIT THE CIGARETTE???? if there were working smoke alarms, would you have been able to get out of there sooner? i know that landlords are to check smoke detectors before someone moves in, but WHO’S RESPONSIBILITY IS IT TO PUSH THAT LITTLE BUTTON SO YOU CAN HEAR THE BEEPS????

I am not sure I understand the logic relating to the smoke detectors portion of the suit (I understand that they should be installed), as I believe the decendent knew there was a fire?
Not to get too technical, but there are (or should be) manifest problems with the concept of proximate causation.
That said, I never cease to be amazed by the propensity of jurors to overlook jury instructions, and judges to allow just about anything into evidence.
