    “A jury in Vermont awarded the money to Diana Levine, who sued Wyeth after she was injected with its Phenergan nausea medication. The drug was inadvertently injected into an artery, which was seriously damaged. Doctors later amputated her arm.”

    so this tells me that it’s not the drug manufacturer, but the physician who gave the drug. so the lawsuit should have been a malpractice lawsuit and stopped there. if a drug is made and the person using it does not use it correctly – it’s the person’s own responsibility not the drug maker. same thing when giving drugs. if the nurse gave the wrong medication, sued the nurse and the hospital – but not the drug maker. same with this case. it’s just a money hungry lawyer and person. i understand she now has a loss of a limb due to wrongful use of a drug. i have compassion, but that still means the hospital and the person giving the drug is responsible.

    I agree with you, wudchuck. This case sounds more like malpractice on behalf of the person who gave her the injection.

    I would be curious to know more details about how the drug was labeled and whether it specifically stated not to inject it into an artery.

    Leet’s be honest here, the drug manufacturer has more coverage than a physican would have. That’s the basis for suing them.

    I’ve taken injectable meidcation and they are labeled for I.M. not I.V. use. As you all say, the case should be against the Doctor, but then the poor poor attorney wouldn’t be able to get as large a fee.

    What a world.

    so, just because they have more money means i can sue them instead?! true, if it was marked wrong, but even still, should not the user of the drug (pharmacists or the doctor) be familiar with the drug to know better as well?

    i bet your going to find that it was probably not labeled wrong since it was not issued by the pharmacists but the drug company. because if it was don’t you think that whole batch of them be labeled wrong and then more than one person wud have been hurt.

    so back to the person, who gave the drug!

    what about the manufacturer of the syringes and needles?
    Is there a case against them….

    As an old med-mal guy I can tell you phenegren has been around for 50 years – great drug – but – when the nurse puts it in the wrong place trouble will arise – there is NO case here at all vs: Wyeth

    I say sue!!! Sue the doctor, the nurse, the schools that trained them, the hospital, the county that licenses them, the drug manufacturer, the FDA, the makers of the delivery system, the manufacturer of the bottle that holds the drug, the printer, paper and ink manufacturers for the labels, the label designers, the schools that trained the chemists that made the drug, have I left anyone out?

    Simple malpractice claim blown all out of proportion. Why can’t we sit on the jury? Oh yeah, biased by a sense of reason and reality.

    I must admit I liked that sarcasm and the addition of the family members. For the life of me, I am surprised that the only common sense I ever find is here. Too bad that common sense is not common at all; I know when I was in high school, my teachers went to great lengths to teach me to use my head for “something more than just a hat rack”… we’ve lost not only personal responsibility in America but also the ability to think independently and critically. Mass society developed a condition known as the “behavioral sink” where it all went down the toilet….this kind of award onlyh confirms it.
