    A short P.S. – after these few years of experience with med mal “reforms” in a number of states, the only benefits seem to be going to the insursance companies who (a) have not reduced premiums, (b) have even increased premiums, and the doctors keep taking it on the chin – hoping to pass along their higher costs to patients, though this is often impossible.

    From the July Best’s Review:

    Since the passage of Proposition 12 in Texas which allowed the sate to impose a $250,000 cap on pain suffering-type awards:

    there are now 30 new carriers in Texas (were down to 4 writing med mal);

    There are 2,533 pending license applications from physicians seeking to setup shop, more than the total number of doctors that were licensed last year; and

    average rates in the physician-liability market are down on average 21.3%

    And Texas isn’t the only state where this has happened. Any other statements you’d like to throw out?
