Pa. Creates Fund for Injured Workers of Employers Without Workers’ Comp

    Welcome to the world of the Soviet Socialist Republic of PA due to Rendell. Work Comp is compulsory for employers with employees in PA, so if the inept goverment would enforce the law this wouldn\’t be needed. Take from everyone and give to the Democrats in Phila, Pittsburgh, Scranton, Wilkes-Barre & Erie.

    I guess this is doing the decent, humane thing by the injured employee who has no control over whether or not the Boss abides by the law. I wonder if the fund will try to subrogate against the employer…

    Let\’s see Sole Props, LLC\’s, LLP\’s and Partnerships are not eligible for WC Benefits in PA. It is not commercially available and they can\’t buy it for themselves BUT if they work for someone they are provided coverage by the party they work for. If THEY have employee\’s then they must provide it for their employee\’s but are not covered by it. The people they work for will be responsible for the WC payment to the injured employee (Sole Prop, LLC, LLP or Partnership) but the insurance company received no premium for the payment they have to make to the injured non-employee AND the employer gets his/her experience mod dinged for the next 3 years. Yup that makes all the sense in the world if you live and work in PA. The legislators of this state are not the brightest folks the state has to offer. They work for their special interest and not the interest of the people. Enforcement??? You gotta be kidding me!! That would require more taxes to form another layer of government that the appropriation committee\’s that passed the original laws set aside but the funds have been raided for other pet projects…SEPTA…etc…
