Kent County (Delaware) Levy Court commissioners have voted to spend more than $32,000 to pay the legal bills for the plaintiffs who defeated new restrictions on development in the county’s coastal zone.
The county’s insurance carrier will pay the plaintiffs nearly $130,000.
The county was ordered to pay the attorney’s fees after a Chancery Court last year ruled the Coastal Zone Protection Overlay Ordinance violated a state law mandating that all similarly zoned land be treated the same for regulatory purposes. The ruling was upheld by the Delaware Supreme Court.
