La. Bill Would Bar Automatic Denial of Claims Because of Water Marks

    Yeah, that\’s what he said. ALL property policies.

    That is, if State Farm and Allstate even stick around if this bill passes. How exactly is an insurance company supposed to prove the damage was flood if they\’re not allowed to use a water line or shifted foundation? That\’s what a flood does, makes a water line and shifts the foundation.

    Louisiana Citizens Property Insurance Corp. may get to collect a surchage up to 20% on other property policies in LA for up to 25 years to pay for insuring properties in south LA that should never have been insured. I wonder what they will do when next year\’s storm hits?

    No, Citizens will and State Farm will, and Allstate will, and every Independent agent company will surcharge 20% on every property (Personal or Commercial) for the next 25 years. Even those 400+ miles away from the coast, as long as they are in the state of louisiana.

    Of course the insurance company can\’t prove its flood damage. The point to force insurers to provide flood coverage – the exclusion be damned.

    So I dont have or dont have enough flood insurance here in S La. I cry to my politician who then feels it is appropriate to set aside contract law and force a contract to cover something it never intended to cover. Really Smart Julie Q ! Make your lawyer pals richer so they can fund your next run for higher office.

    Mrs Q\’s bill is typical LA Politics. Once again I\’m amazed at the fact that no one can take responsibility for their own actions. Non-Flood Zone homeowners CHOSE not to have Flood Insurance and since they rolled the dice and lost, someone else has to pay for their poor decision. Yes, a tragedy. But why should the rest of us in this State pay for their poor decisions. Then I ask, WHY does the NFIP limit the amount of Flood Coverage one can purchase, when 1000\’s are willing to pay the additional premium. But I\’m sure Mrs Q will make economics and diversity a major issue with this just like everything else in South LA. Some things never change.
