Allstate the Winner in Texas Chiropractic Lawsuit

    The allegations against this company have been around a long time. A trial has determined that they have merit. This type of behavior is inappropriate and should be stopped. Greed should not be the foundation of health care delivery and when allowed to continue, it takes its toll on all of us including those working hard to help patients.

    Actual tort reform in the States should all begin by establishing a chiro review board with power to enforce abuse. The extra incentive for the chiros to split fees with the plaintiff attornies and provide the runners for claims, continues to fuel the fraud and abuse. It is a main driver of increased rates to the public.

    Allstate has won a victory that the Texas Workers’ Compensation insurance idustry has been unable to win. That is, those medical provider offices whose raison d’etre is to bilk insurance companies rather than treat patients operate “legitimately” within the liberal allowances of the workers’ compensation system.

    The verdict and trial court judgment were reversed by the Fifth Circuit Court of Appeals in Allstate Ins. Co. v. Receivable Finance Company, L.L.C., 501 F.3d 398 (5th Cir. 2007). Judgment was rendered in favor of all defendants that Allstate take nothing on its claims.

    I am really not surprised to hear about A&I Chiropractic’s law suit. I am a former employee (a Medical Report Writer) for A&I’s Corporate Office. There was employee layoffs at the Corporate Office in March of 1993 (the reason given was that due to the 9/11 incident, and bad company stock investments, the company had to perform layoffs). Myself and another employee in particular (John) were top producers for this company (in the Production Department), and it is very enlightening to know the real reason for the layoff was due to the fraud/greed/abuse/mismanagement by this company. However, I was extremely sorry to hear that the decision was overturned/reversed in 2008.

    Yes, Miguel, I totally agree. You and I were the most productive members of the medical report writers. By the way, I hope you’re doing well. I was also quite surprised the the decision was reversed. I remember customers being sent for MRIs and other diagnostic tests, even when the accident injuries were minor. The reason for my lay-off was that the company’s legal expenses were exorbitant and that the company was laying off the top producers/earners to save money. Yet, they chose to lay off their top two report writers to save money. Does that make sense? You would think it would be the other way around. Suffice it to say, as an employee of A&I and being a first-hand witness of the exorbitant hirings they lay-offs, it is obvious that A&I does not value their employees (maybe they value their low-wage employees). If the company were truly trying to save money, they could have pulled their Darren Woodson advertisements. I bet A&I pay him for those advertisements what you and I both made for our yearly salaries. I truly believe it’s just another example of corporate greed, where the CEOs bottom line means more to him that the employees. Besides, employees are indispensable, right? I really found it ironic that we were laid off only a week after we received commendations and recognition plaques thanking us for going “above and beyond.” Just another example of office bull crap. I wonder why the sudden reversal in the verdict. It really makes me wonder. Take care, MBM! Hope you’re still enjoying your music. Bye! Jon
