He owes them more than just the premiums, he owes them the peace of mind that they thought they had purchased but did not. Also, medicare and the products that are sold to medicare eligible people have specific open enrollment periods that must be followed. He did more than break the law, he put people in grave risk of huge debt and put them in a bad spot for getting legitimate products to suppliment their healthcare needs – and the cost gets higher the older they are, so he cost them more $$$ no matter what. My opinion, this coming from an insurance agent, take his house, vehicles, savings, retirement, garnish future wages, and throw him in prison for a few years so he has some quiet time to think about it and so others who think taking advantage of senior citizens is a good way to make fast money will think twice. Also, make sure he cannot get an insurance license in any other state – often times that will happen, he may move to another state and start doing the same thing again after the dust settles. Make sure his life is over.

What these stories never tell you is if any of the victims suffered claims prior to the fraud being discovered. He shouldn’t be allowed to retain a pot to piss in let alone his home. The magnitude of his crime may not be known for some time to come and he basically skates. The lack of personal responsibility is slowly destroying this country from within.

The collapse of America continues. How does a piece of human garbage like this who screwed the old folks and pocketed “tens of thousands of dollars” get off with 30-days and no restitution, and keeps his $375,000 home? In Kansas that’s a freaking mansion. The bankruptcy laws in this country are a joke. So are the judges who administer it. You don’t steal from someone and end up profiting from you actions. I’m going to call Paul Kersey (Charles Bronson) and see if we can get some justice.

The bankruptcy court can deny inclusion of the inclusion of the items in the previously settled criminal and civil claims.
They could even reject the bankruptcy filing all together.

    The should do so.
The legislature should amend Kansas bankruptcy law to prevent a criminal from profiting by filing for bankruptcy.
The criminal trial courts could send him to prison, since he has not paid and is refusing to pay restitution, a violation of the plea agreements.

This creep would benefit from some “street justice” since we can’t depend on our badly warped legal system to provide justice. I’d like to see the old folks he rear-ended beat the crap out of him with their canes and walkers.

If he is required to make restitution, and does not, doesn’t the sentencing guideline compel the Judge to mandate jailtime?
