    Doctors can only go on what they know. Since the doctors were cleared the hospital should have been cleared as well. Kids bust their heads open all the time (me once and my little sister three times) without it being from abuse. This ruling is bogus.

    Juries make findings, not rulings.

    A hospital is more than just doctors.

    There’s no way you can rationally determine that a verdict is “b.s.” without knowing all the facts.

    So . . you’re an idiot.

    Maybe there is more then meets the eye but where does this end? If you lived next door to this family and didnt call the cops are you gonna be named in the court suit next, to possibly be find liable for $400,000. The man beat the child to death.
    How is that anyones fault but his own? I think there are bigger questions here.
    Questions for the judges who put these guys back on the streets to hurt again. The judicial system that seems to have mercy for those who give none to others.
    Quite the contrary.If we did things my way, the man who killed the child would work to pay for the costs of his sentence, for the rest of life from prison, no TV, no internet, no fun at all, just work till he dies. I think THAT would be fair.

    I deeply resent that a child murderer is free to kill another child. And the baby’s mother should be sitting in the prison down the street for not stopping it herself. Once again, the ‘it’s not my fault’ syndrome. Where was the family that will now get rich when this baby was being beaten to death??????? THEY are the ones that should have called the cops.

    BUT- the end result will be that anytime you take your child to the hospital for a bump or bruise, they WILL file a police report to cover their legal behinds. Social Services will be called upon to investigate any injury and the parents of a child that falls off their bike will have to PROVE that’s what happened. And the system, already stretched beyond what it can handle, will most likely end up failing more children that really are abused.

    Dawn is correct. Why would a jury ascribe to the hospital a higher standard than they would to the Mother of this child who allowed the child to come home to an abusive boyfriend, only to ultimately have the abuse continue until he was killed? Now, because of the Jury’s determination, that Mother is not only free in society, she is now wealthy. Wonder if the boyfriend, who served two years, is back in her life?

    the real story is that the boyfriend got 2 years in jail for killing the boy….what’s up with that! I say the hospital should be allowed to harvest him for parts to pay their expenses.

    Hey guys – we did this one yesterday – some new commentary as did not draw much on 03/13 – The rational gal is correct – health care providers (doc, hospitals etc) are Mandated Reporters and any time they have reasonable evidence there is abuse going on they are required to notify the proper authorities – but – because they are at risk for “adverse consequences’ despite a provision in the law that is supposed to protect them and because CPS is so gawd-awful at protecting kids even if they DO report, we see outcomes such as this time and again. These jurors wanted to ‘send a message’ and did so – to the wrong parties

    Speaking for myself, I’m sick and tired of our courts bastardizing the legal system and transferring responsibility for this kind of social problem. The issue here is irresponsible, negligent, and criminal behavior of an adult. You don’t make hospitals, teachers, and others responsible for preventing children from being abused by their biological parents. THE PARENTS ARE THE ONES RESPONSIBLE…….or irresponsible in this case. We have a child born to unwed parents. The “mother”‘s live-in boyfriend kills the child. Now the father steps up and wants money. Some people are incapable of parenting. In fact, they’re so ignorant they don’t have enough sense to use birth control. Whey you allow a certain “element” to live on the dole, they’ll always blame the system.
