It isn’t that I am condoning sub-par health and safety practices by food companies. But due to the increasing number of lawsuits against… anyone and everyone, I have become so desensitized to situations like these where a person dies and SOMEONE has to be responsible and therefore pay for it. Yes, family of the woman who dies, the millions you will be awarded will comfort you in your time of need.
Hank, lawsuits have to be filed and won in cases like this. Yes, it’s sad that people die and no money will ever bring them back, however, if the companies have to cough up millions, then they may take some precautions against this in the future, thus saving lives. If lawsuits were not allowed, what incentive would a company have to test for this? None, as it would effect their bottom line. However, if it were cheaper to test for this and avoid expensive lawsuits, then testing would help out their bottom line. Do you see where I’m going with this?

I do see where you are going with this, but I am not arguing with you. My point was that I have become desensitized by all the ridiculous lawsuits that I now view instances such as this with cynicism. A person died due to something that was most likely an accident. I am very certain that peanut butter firms do all they can to avoid mistakes and tragedy, but now they will pay, both due to fines and this lawsuit. If we are only concerned with making sure that this won’t happen again, shouldn’t the fine be deterrent enough? What purpose will the lawsuit serve, other than to fatten the family’s wallet?
Maybe the old bag had one foot in the ground already and we just saved millions in medicaid. Perhaps Peanut Corp should be given a key to the City and praised for their heroic stance
There is another approach that wouldn’t involve lawsuits. Just collect some tax money and start a government agency to oversee food safety and enforce safe manufacturing practices and testing of food, drugs, etc.
If we had something like that, we could expect that reasonable precautions are being taken, or else companies would face fines and the enormous costs of recalling potentially dangerous products.
If only we had a system like that, lawsuits like this one would be considered frivolous, only filed by opportunists preying on other people’s bad luck.
