The Bozeman Police Department is asking a judge to reject proposed sanctions against the force for allegedly covering up details of a police stun gun incident that left a Montana man with serious head injuries.
Attorneys for Soheil Jesse Verdi claim someone deleted a portion of an audio recording that captured his 2007 encounter with officers.
But police attorneys say in documents filed Monday there is no evidence anything was deleted.
They say even if a portion of the recording was lost, officers had no duty to preserve it because they did not know Verdi would sue.
The officers used a Taser on Verdi after he answered the door naked and intoxicated during a welfare check, then allegedly attacked them. Verdi fell and suffered head injuries.
He is seeking unspecified damages.
