Iowa Woman Convicted in Fatal Crash Sued by Victim’s Family

A Clinton, Iowa woman convicted of driving drunk and killing her boyfriend in a crash is being sued by the man’s daughter and the girl’s mother.

Lilly Wilkerson was convicted of vehicular homicide and drunken driving and sentenced to 10 years in prison for a Dec. 26, 2005, crash that killed 24-year-old Jesse Van Scoyoc.

She is being sued by Van Scoyoc’s daughter Haley Van Scoyoc, and her mother, Amanda Montroy. State Farm Mutual Automobile Insurance Co. is also listed as a defendant in the lawsuit.

It claims that Haley, who was 17 months old at the time of her father’s death, will lose the value of financial support and services that would have come from her father.

The lawsuit, among its claims, says that Wilkerson was underinsured, and that her insurance policy has limits that will not fully compensate the girl for the loss and damages.

The plaintiffs are seeking a judgment against the defendants in the amount of the underinsured motorist coverage, and costs of the lawsuit.
