Oregon Trucker Who Refused to Drive Unsafe Vehicle Gets Job Back

    The truck driver’s claim was brought under the Surface Transportation Assistance Act which prohibits retaliation against drivers because they refuse to drive in violation of a commercial vehicle safety regulation or complain about violations of commercial vehicle safety regulation. A successful claimant is entitled to reinstatement, back pay, attorney fees, and, in appropriate cases, damages for mental pain and up to $250,000 in punitive damages.
