This article is interesting only in that it fails to mention anything about why the insured apparently failed to file a property claim with Colony as well as a Liability claim with Scottsdale. It implies that the insured filed the claim(s) directly as opposed to their agent/broker. And unless the agent/broker was unaware of the loss, and excluded from the process by the insured filing directly, why wasn’t the agent/broker being sued as well?
