    If our legal system allows this to proceed, we should all be outraged. How dare a criminal sue the property owner? The old man should have used a shotgun or larger calibre pistol and this never would have happened.

      One can only hope that the good folks of Cali do the right thing
      and either throw out this suit or find for the Defendant. Too
      Bad the old guy was not a better shot, under duress, as this
      would be a mute issue. The Plaintiff’s bar should be proud…

      YOU ARE SO CORRECT!! MARIN IS A CRIMINAL OPERATION PAID FOR BY US THE TAX PAYERS WHICH YOU CAN SEE IN THE SUPERIOR COURT CALENDAR DAILY.

      THE COUNTY WILL PROSTITUTE ITSELF FOR A PENNY PARTICULARLY WHEN IT COMES TO ANY PERSON WHO IS OF COLOR, A WOMAN, CHILDREN AND THE RETIREES IN THIS LIFE.

      JERRY BROWN’S OFFICE SHOULD PUNISH ALL OF THE COPS AND JUDGES FOR THEIR CRIMES OF ALLOWING THESE KINDS OF CASES TO ENTER ANY COURT.

      I sincerely hope this jerk is proceeding pro se. If a lawyer actually took on the case of a criminal suing an elderly man who was protecting himself, that lawyer should be immediately disbarred. This lawsuit is the very definition of frivolous and a waste of judicial resources.

    only in california!!! Iam amazed that the citizens of this state can still eveb own a gun. 90 years old, my hat is off to you. I agree with the last comment completely. do your fellow californians , and the rest of us, a favor and go to the gun shop tomorrow and buy something more terminal

      I thought there was a legal case that settled the issue of criminals suing property owners for injuries sustained during the
      commission of crimes. If there isn’t a blanket prohibition now,
      how many minutes would it take to write that law and pass it?

    In california you never know what will happen. I am not sure about the rights of the perp in that state. In georgia where I live, police would have advised the homeowner to get a bigger weapon, so that the next time they would not have to hall him into jail. The coroner could take the case.

      If we had the application of cruel and appropriate punishment for all crimes against children, and seniors, I think there’d be a lot
      less of these sorts of crimes. Why clog the courts with cases like this?
