Lawyers Throw Workers’ Comp Deal on the Rocks

    WC is an albatross that needs to be eliminated. Having handled claims for 4 decades, I can attest to the abuse and waste of this antiquated program. When a worker has a shot at a permanent disability (full or partial) he’s going for it. WC fraud is much costlier than reported. When a worker is injured due to his own stupidity or carlessness he doesn’t deserve to get paid for time off and rewarded by getting a tax free payment for life.

    Having been in the industry for 25 years and as a former claims adjuster I can say that workers comp is no different than any other insurance benefit program. The people that need the benefit don’t get enough and the people that “milk” the system get more than they should. It is no different than medi-cal, state-disability or a host of other programs.

    I will say that most parties in the industry have a mindset that is difficult to set aside. Claims people tend to think fraud is worse than it is (It is a felony if proven, by the way). Applicant Attorneys tend to think the injured is skrewed by the insurance company continuously etc.
