Family of Man That Died at Montana Pool Sues City

The family of a 41-year-old Billings man who died of a heart attack at a city pool last summer is suing the Montana city alleging it failed to provide for the safety of pool users.

Bart Bieber died July 24 after swimming with his wife and three children.

The April 12 lawsuit alleges the city was negligent for not having an automated external defibrillator available at Rose Park and because it was obligated to instruct its lifeguards and other employees to call 911 if anyone went into cardiac arrest.

Bieber’s wife Therese, a nurse, and an off-duty fireman performed CPR. The lawsuit alleges a bystander, not a pool employee, called 911 about 10 minutes after Bieber collapsed.

The suit seeks unspecified damages.

City Attorney Brent Brooks says the city’s initial response is due by May 9.
