Widow Sues Utah Crematory, Claims Ashes Mix-Up

April 27, 2012

A New Mexico widow is suing a Utah crematory after she says they gave her ashes that weren’t her husband’s.

Marilynn Flynn of Alamogordo is suing McDougal Funeral Home, claiming the Taylorsville business was negligent, violated a contract and intentionally inflicted emotional distress.

Flynn’s husband, Michael Wayne Flynn, was among three employees of a Montana-based firefighting company who died when their plane crashed into a mountainside in rural Tooele County, Utah, on April 25, 2009.

Michael Flynn’s body was recovered and cremated, but Marilyn Flynn says she didn’t open the urn until almost a year later as she prepared for her husband’s funeral.

She found a dental bridge fragment and a crown that didn’t belong to her husband.

Representatives from the funeral home declined comment to the Associated Press.
