Father Sues California Hospital Over Son’s Brain Damage

    All procedures done to a minor have to receive consent from a legal guardian. If they new that there was a language barrier then they should have found an interpretor and obtained approval for the procedure IN WRITING!

    If a an otherwise “normal” full term baby had the hernia surgery and then showed signs of brain damage, I think this man would have a good case- but, according to the article, the baby was 4 months premature!

    The other side to this is that even if he had a good case, is the damage amount of $19 million appropriate?

    These are the kind of lawsuits that need to stop.

    For a minute there, I thought you were going to bring up the cost FACTOR, the hospital is charging. Got to pay for those lawyers some how.

    Or, a Benign suit for LA.

    Blue Shield (both EPO and HMO) is no longer an available health plan for new enrollments. Starting on March 19, 2010, new subscribers cannot have Blue Shield as their health plan.

    If a child currently has Blue Shield as their plan in Healthy Families, Blue Shield will continue to provide services to the child. If the child’s coverage ends and the family re-applies, Blue Shield will no longer be an available health plan during re-enrollment.

    I wonder where this family now stands in the Big circle of life.
