This is a sad case. Just think of the back pain he must have had. I would have hate to be in his shoes. I don’t disagree that this should be looked at further for some type of benefit.

While I see the reasoning one must still wonder whether there had been prior bouts of depression, etc. With the economy in the shape it is in, foreclosures on the rise and prices for everything increasing, this just sets a bad precedent.

I have to agree with you. On the other side of the coin – What about Life Insurance? Will this ruling also be able to start effecting how those benefits are paid out and excluded in suicides? Will it open the door to new ruling on that arena of insurance? If their is a mitigating circumstance to the suicide, i.e work related stress/anxiety, etc. can we force life insurance companies to pay as it was out of the insured’s hands (like it is in this case)

It is horrible what happened but we have to remember personal accountability & decisions.

    M,
After being in force for two years, a life insurance policy is incontestable and they have to pay any suicide claim. Regardless, I don’t think a W/C policy should pay for a suicide claim.

This is one reason w/c should continue to not cover mental health conditions. This ruling opens the door for many other conditions that are not caused by work but will be blamed on the work. I know it’s the “slippery slope” argument, but it’s still valid.

It’s sad he felt he couldn’t take the pain anymore, but this is a bad ruling.

For all of you that have not been subjected to workerscomp laws. After years of having everyday citizens lives sold down the river for a golf game and a steak dinner to have laws passed in the insurances favor. The laws are bad putting it mildly, lets say your back is so screwed up that your pyhsician labels you totally disabled and the us government agrees and puts you on ssi disability you think you would be able to get on with your life from there, oh but wait, with the current laws all the insurance company has to do is send you to a “doctor” of their choice who will say there is nothing wrong with you and you should be at work and further more you dont need any medications at all.Well it happens daily across america puhing peoples lives over the edge, their put in a position of no where to turn, they dont get paid and lose their homes, they dont get the meds they need to feel reasonably comfortable and all of this legal, because of a steak dinner and a round of golf. Make no mistake these people are respondsable for tormenting innocent peoples live for the crime of getting hurt on the job. I can only wish this never happens to you.
