    At .08, you are presumed to be impaired. It is also illegal to drive while your BAC is at .08 or greater under ARS 28-1381a2. Therefore, when your BAC is .08 or greater, you are charged with 2 offenses…driving while you are impaired to the slightest degree, and driving with BAC of .08 or greater.

    AZ legislature passed a law that says you are guilty of extreme DUI if you drive with a BAC of .15 or greater. That means .08-.14 is a regular DUI. The penalties for an extreme are greater.

    AZ legislature recently passed a law that says you will suffer greater penalties under the extreme DUI statute if your BAC is .2 or greater. This is the “super DUI.”

    I wonder why it took the cops so long to bust this flamer? I doubt this idiot from “across the border” has insurance to pay for all the damage he caused. Guess who’s going to pay for it in the form of auto premiums? Judging by his age and extremely poor judgment, I doubt this is a “first offense”. He should have his license revoked for life and his vehicle confiscated and sold to pay for some of the damage he caused. Although I doubt a 1962 Ford pick-up is worth much. America needs to adopt a zero tolerance policy for some behaviors that are particularly dangerous to the public. Like this one. In the meantime, the courts sentence some poor schmuck to 2 years for smoking a joint in his own home.
