Another absurd verdict by an un-educated jury acting on sympathy. Black ice isn’t readily detected hence there is no notice or duty to safeguard an area. The pltf. efforts to avoid another vehicle suggests excessive speed for the conditions, failure to assure clear distance, and possible over-correction. Being familiar with the are and knowing bridges freeze before roadways should have made the pltf. more cautious. Even with salting, there’s no 100% guarantee this could have been prevented.
Why didn’t the DOT just put up a sign that says the road may be slippery when it’s icy. They should take that jury & send them out on the same road. This verdict sucks.
First off, this article was misinformed. He was not trying to avoid another vehicle. The other accident was in the median. Secondly, when you see police lights flashing what do you do, you normally slow down, which is what happened. A newspaper isn’t always accurate and you shouldn’t base your decisions on them. You don’t have to agree with the verdict, that’s fine, not all do, but DOT should take their responsibility in trying to maintain safe roads, in which they did not. Which is what the verdict was based off of.

I certainly hope this is overturned on appeal.
and jurors should be euthanized.
I just hope the insurance carrier or the D.O.T. if it’s self-insured has the stones to file an appeal.
