California Court Rules on Age Discrimination in Workers’ Comp Claim

    In workers’ compensation the rating is a math formula which is adjusted for age. For injured workers over 39 the rating is increased. For younger workers it is lowered. The older an injured worker is the higher the rating. I wonder why the aged worker never complains about that discriminatory practice? Because they get the benefit. Why doesn’t the insurance carrier complain? That might be a nice test case.

    This isn’t age discrimination, it sounds more like it was based on her physical condition prior to the injury. It sounds like she is trying to get replacement value when all she bought was ACV.

    We aged workers never complain when we get special favoring treatment because we are wise.

    This kind of finding does, however, make it even harder to convince businesses to hire us old folks who still want to work
