Mont. Jury Awards Former BNSF Employee $1 Million in Injury Damages

    Another reason we need professional, educated, objective juror like Japan uses. The old man fell doing a job he’s done his entire life and is rewarded with a $1MM retirement bonus. Wonder why WC wasn’t his only remedy?

    WC wasn’t his only remedy because of a bleeding heart jury. I’m sure the poor guy was/is in a lot of pain, but the no negligence theory of WC should have taken care of his injury.

    Ever heard of the FELA? Railroad workers fall under this act instead of WC. You might say it’s kind of like Court house comp.

    I wouldn’t trade a million dollars to have life long pain, the risk of paralysis, and to live knowing that I’m going to have to have more back and neck surgery. – What is “just wrong” is how BNSF treats their injured employees. What is “just wrong” is that BNSF knowingly allows unsafe work conditions to exist because it is cheaper to hurt their guys than it is to provide them enough man power and the proper equipment to do the work. What is “just wrong” is that BNSF uses tactics against their injured workers to wear them down and get them to settle for a pittance of what BNSF’s responsibility is. Most of these guys have to wait 5 to 7 years to even get their cases in front of a jury. Then, (as they certainly have by now with Mr. Roney’s case) they will appeal and drag it out even longer hoping to never have to pay for their negligence. Look around on the web a bit to see what sort of injury statistics there are for all the RRs. Look up what is called “The Dupont Study” that was commissioned by the American Association Of Rail Roads.

    Go talk to some RR workers. Find out why it is that only 2 or 3 % of the Maintenance of Way workers make it to retirement age. You will discover it is because they destroy the backs, necks, and knees of 90% of their MOW work force and the rest they expose to dangerous chemicals and sicken them or they outright kill them on the job.
