    from WalMart’s experience. WalMart got spanked pretty hard by the legal system when they tried to pull this one.

    It seems some employers will never learn. PepsiCo had to be sued a couple times for different divisions violating wage and hour laws. There will always be someone trying to screw the average worker.

    Does anyone know the legal defination of this term or where I could research it.

    You can pick up the definition from your state by visiting the website for the Bureau of Labor and Industry – or whatever you call that division. Google wage and hour laws for your state and it will come up.

    Generally exempt employees must:

    Earn a certain wage (in some states and federally)

    Have broad discretion in how the job is performed.

    Require special skills/training/experience/knowledge/education

    Those are the basics. There are others depending on your state.

    Unfortunately lastbat, there is always a worker (or two) trying to screw over their employer with false W/C claims, EEOC claims, wage/hour claims, etc. It appears that NO ONE ever learns….
