    Empirical evidence?I have yet to understand what this means.Who is interpeting this?The fact that work-comp rates have dropped should be news to celebrate.

    This was only a trial judge decision. It has not seen (and may not see) appellate review. It is not precedent for anything except a lot of good wishes and hope by the applicant\’s bar. The WCAB, in its en banc decision in Costa, already determined the new rating schedule is appropriate. This local workers\’ compensation may very well be correct, but its a long way from being over based on this decision alone.

    I Can tell you I don\’t feel sorry for the poor man that injured his knee and wants to be paid for it the rest of his life……he still has two arms and legs, use them, don\’t use the system,…..we might all start benefiting from that. Sorry to hear the ruling was overturned.

    True, celebration is in order but Empirical data is based on the law of large numbers. In simplistic terms, it is a probability measure of a string of events. No one string is going to produce the same number of events, so they are statistically compared to arrive at a probability that makes a statement, for example the statement may be that knee injuries have a greater probability of frequency than ankle injuries. Therefore, the actuaries use this information to base rates.

    Does anyone remember when Arnold Schwartzanegger had an accident on his motor-cycle resulting in facial damage?
    I wonder if “HE” filed a claim? And if so what type?

    I will not feel sorry for you critisizer when you get hurt. If you do try not to waffle to much on you’re “Right’s” but use the “saving’s account” to total exaustion as have others so you can make you’re monthly payment’s Also stop paying into a system that you have no intention to allocate from. Further more can you tell me where I can get a crystal ball like the one “you” have?

    I know there have been abuses in the system, but once you get injured on the job as I have, resulting in a 40% disability to both hands with the prospect of total disability in two years if I don’t stop working, and are told that your hands are only worth $11,050, then maybe you’ll feel differently. Oh yes, and even though you want to keep your medical open (which is why you take the paltry sum), the insurer can refuse to pay for your medical.

    My Dr. has been working with me since my injury in Aug 2006. He has now told me that I am permanantly disabled. Where do I go from here? Do I get disability money coming in my household? Where do I apply? I am 54 years old. I can use all the help I can get.

    Sure, the system is being abused by some, but don’t lay a blanket punishment for all. The state should punish state employees that are too lazy to tighten up and follow through with false claims. People are so insensitive, and easy to condemn until it happens to them, then it’s an immediate 180 degrees.
