    I\’m more shocked that anyone had tenure that long in Circuit City; they have a rep for going thru personnel like toilet paper.

    I\’m shocked that management at CC hasn\’t put falling sales combined with their cost-cutting measures together and figured out why nobody shops there.

    I suspect that if Circuit City took the position that they will \”Pay-for-Performance – within the position grade\”, rather than \”position grade – with a length of service factor\”, then those same employee-plaintiffs would indicate that it is unfair, because they are not getting paid for their years of service (which, of course one would expect to be more for the older person(s). Circuit should lay off everyone, and have them re-apply. Set a wage rate that rewards the better performers. What is unfair or Age-discriminatory about that?
