It would be nice to know what insurance coverage he had that would kick in here.

Good question LLCJ! I want the kind of policy that will defend me when I beat someones a**! Oh and while I\’m at it, I might as well pick up one of those umbrellas that will afford me defense when I knock over a liquor store!

That would be the \”Ima Idiot\” endorsement to the \”Everybody Owes Me\” policy.

Didn\’t this guy attend and graduate from some institution of higher education? why rely on racial discrimination as the reason for this? Thomas Sowell said so long as blacks continue to use race as their crutch, the will hobble all their lives. But alleging that someone else\’s insurance owes a duty to defend HIM, is beyond me.

What coverage? How about the liability coverage on his homeowner\’s policy? If he\’s accused of a tort, then his insurance company has a duty to defend him and to pay out any legal obligation (up to the policy limits, subject to a deductible).

Aren\’t you people familiar with basic insurance?

From reading the article, it appears the good Mr. Davis just stood there doing nothing while the bad ol\’ bouncers choked him and wrestled him to the floor for no apparent reason. I think he should collect just for his inconvenience of being in the wrong place at the wrong time.

Tort Liability?!? What about excluding BI or PD that is intended or expected? If you assault someone, isn\’t BI generally expected to occur? He\’s got to prove that he hurt someone by accident. \”My fist just happened to slam into that bouncer\’s face…I don\’t know what happened?\”

That would be a finding of fact left to a judge through a dec action…Liberty still owed a defense until that had been decided.

Why would his homeowners policy kick in here?
