California Pair Sentenced for Workers’ Comp Fraud

    Finally some actual punishment for WC fraud. Now if only State Fund would go after people like Golden Eagle apparently does.

    FYI, Mr/Ms Sheep, the State Fund has a very successful track record in prosecuting fraud and litigating cases and decisions adverse to Calif WC costs. The lament might more fittingly be expressed: “…if only all carriers would go after [fraudulent] people like the State Fund does.” Many carriers have reduced their fraud fighting departments because they are expensive to maintain and the payoff is many years down the road. The State Fund, on the other hand, has an advantage of scale and are patient enough to wait for the results.

    Yeah, right. Hooray for Golden Eagle. So the guy goes back to work at the first employer and they’re still paying TD. Let’s see. . . Did he return to work for the first employer without a doctor’s release, or was GEagle paying him TD despite the doctor’s release? Maybe a little problem in communication between the insurer and the insured. In the year 2000, by my personal experience, you could make telephonic contact with GEagle adjustors in about three weeks time, if you were really, really persistant. And wasn’t that about the time to founder took the solid gold parachute after ten years of selling policies at a premium rate that any idiot could see wouldn’t cover claims? Then he left the Department of Insurance to pick up the pieces by selling the whole mess to Liberty Mutual. (Wouldn’t it be fun to review the terms on that deal?) I suppose they could have dealt with it simply by taking GEagle into bankruptcy and dumping it on the insurance industry via CIGA, along with Superior National, Fremont, and all the other high flyers who went for market share over sound management, which was great until the stock market tanked. None of this is any excuse for insurance fraud, of course, but the big problems in the industry don’t originate with the claimants.

    Dear John:

    Its wonderful to hear that the State Fund procutes many fraud cases but you need to publish the convictions in the Times, Registar and other California papers so people who are thinking about fraud may think twice. The convictions should be listed on Page one, not page 32.

    Now all we need, is to show that also Insurance Companies are Fraudulant towards the Injured Workers and get them prosecuted.
    Definatly publish the findings on the front pages of Newspapers. Stop hiding the evidence on the last page.
