One of the issues affecting the rising cost of insurance premiums for employers in California is the fact that employer’s do not have any due process regarding their claims. Insurance companies and Applicant Attorneys control the costs and the life of the claims. Employers are not able to dispute the validity of a claim, or appeal an insurer’s determination regarding benefits. Also, the labor codes written to offer incentives to employers for hiring people with pre-existing conditions are not considered by the insurer’s and, therefore, employers are being denied benefits due them.

Reforming California worker’s compensation is going to take more than these suggestions, but perhaps if employer’s had the same due process that applicants have, the employer’s might be able to control their claim costs better, thus holding down rising premiums.

    Mark,

If you can contact me, we might be able to help. A lot of variables can impact your rates, other than claims. (775) 827-1555.
