Calif. Commissioner Enjoined from Implementing Flawed Fair Claims Settlement Practice Regs

    The DOI recently performed an audit of you company’s claims files. After reading the results, I would request that the DOI advise insurance companies of any changes in regulations and/or interpertation of regulations. This would enable the insurance companies to better serve our customers within the DOI regulations.

    After working with a major carrier and the DOI on claims issues. It is apparent that the DOI and the insurance companies need to be more proactive in the way they implement and comply with regulations. How can the DOI not be able to define their own regulations in a consistant manner? How can the DOI just now come forth and start looking into the way insurance claims were handled during a major fire months after the fact? And, how can a major carrier fail to train their agents in the proper evaluation of cost to rebuild a home? We need a Insurance Commissioner that has the knowledge and courage to act in a proactive manner and move ahead in creating a fair insurance market for the good of consumers.
