Circuit Court of Appeals Upholds Calif. Earthquake Law

A California law allowing homeowners to renew insurance claims from the 1994 Northridge earthquake was upheld March 3 by a federal appeals court, according to the Associated Press.

The law was challenged by insurers in an attempt to block victims from refilling claims.

Both the U.S. Supreme Court and the California Supreme Court have rejected a legal challenge to the law that was filed in Los Angeles County Superior Court.

However, a federal court judge had ruled the law unconstitutional another case. That decision was reversed by the 9th U.S. Circuit Court of Appeals March 3.

California lawmakers permitted the extension due to allegations that victims were not receiving the proper monies due to them by insurers, allowing them more time to re-submit claims they were unsatisfied with.
