Am I missing something? The decedent had a condition that can occasionally cause severe problems after strenuous activity, yet he chose chose to continue playing football despite the risks associated with is underlying health condition. How is anyone at fault here? This case should be thrown out immediately, but I’m sure the University (or its insurer) will pay something to settle anyway, which I’m sure is why the suit was filed in the first place.

Establishing negligence will be difficult. What are the damages? The kid was in school and didn’t contribute financially to supporting the family hence there are no pecuniary damages.
