    Why is this all on Texaco?

    Texaco is a franchise business. They did not own, supervise or control the business at this location…so how do they get tagged for 19M for someone alleging damages from a building they didn’t even own? Where is the franchise owner, building owner, EPA, etc? What about her employer that leased or owned the building the employees were working in?

    Well…at one time it was a Texaco station and obviously Texaco has very deep pockets…so let’s just sue them!

    Texaco needs to fight this.

    It’s too funny, “My children have mental retardation and learning disabilities because of leaded gasoline” Anyone think maybe it’s because you married your cousin?

    Mississippi has always been one of the top ten “litigation hell holes”. This is a classis example of why we need professional jurors who are well-educated and compensated, and can be objective in rendering verdicts and awards. Since nobody gets “a jury of peers”, we end up with a bunch of bleeding hearts who can’t set any perspective on liability and damages.
    p.s. this would never have happended if they didn’t allow their kids to drink the stuff.

    I owned a convenience store for 7 years and was there typically 10 hours a day,
    5-7 days a week. I had 3 children during that time and they’re all smart. My youngest would actually qualify as a genius. If this story were true no one would be able to work there, put gas in their car, drive a car…..you get the picture. I am SO tired of it! Throw the lawsuits out and make them pay when they lose them.

    This was the downfall of Texaco’s whole case. “According to court records, the defense’s expert testified Simon was exposed to 46,000 times the safe level for exposure to leaded gasoline fumes.” I think they should have left the Plantiff’s attorney make that statement. And why do Lawyers make the amount of money they do? What a messed up society we live in. Next you’ll tell me that we make the working class people pay to keep big businesses that have made bad business decisions alive.
