    Too bad the seller’s screen name wasn’t ambulancechaser18, he probably wouldn’t have made the comment.

    Please God, don’t let that lawyer see this. It’s just a joke guy, please don’t sue.

    Could he countersue ebay for setting up a feedback reputation system that is apparently defamatory by default?

    It’s not a novel concept; we’ve been at this for a decade now. Get what was sold, leave positive feedback. Get your chain jerked, leave negative feedback. Something can’t be advertised as “works great” but “as is”.

    I’m going to sue IJ for blood pressure medication that I need after reading all these horrible lawyer stories. (joke)

    The feedback system I believe to be more of an opinion system than anything else. You can’t sue someone for having a bad opinion of you.

    This is a frivilous case and should be thrown out. It’s no different than someone suing you because they don’t like your opinion.

    The real kick is this guys positive rating? It’s 90% from sellers that he paid on time. Of course they’re going to give you a positive rating if you pay them! This is the reason that most people have become afraid to speak their mind anymore. It’s takes a special brand of brain donor to do something like this.

    My philosophy is: Don’t put anything in writing you wouldn’t want to see in the front page of the local newspaper; stick to the facts that can be documented.

    Other thing they forgot to mention in the story is that this was for a time clock. The clock came in three pieces from 3 different models and didn’t work. Also there was another comment on his profile that indicated that he advised that buyer to unload the broken unit on another buyer.

    I really think this mike needs to get an acount together for people to help out. Once the counter suit is one, file with the bar association. These are the lawyers everyone hates, and what is the deal with Miami for not dismissing the suit to begin with?
