I don’t know the medical issues involved here, but if the doctor was immune from being sued because he worked for a public hospital, and is now being penalized because he didn’t raise that issue in a timely manner, it seems like its the fault of the lawyer, not the doctor. This just doesn’t seem right.

I don’t know that I agree with making a doctor “un-suable” because he works for a public hospital, but if that’s the law, this doctor shouldn’t be punished because his lawyer screwed up.

It appears from the article that he represented himself. There was never a lawyer reference and it states that him and his wife were preparing.

This is the reason he should have gotten a lawyer!

Well, peep this portion of the article:

“Helen Grimes sued Dr. James Warrington Jr. in 2001 for medical malpractice in the death of her husband, John Grimes.”

    Tag, you’re it! LOL

Slight correction, Shannon: the wife you referenced is the widow actually, not the doctor’s wife.

    Big Mike:

No, actually, I was referring to this portion: “However, the court record showed that for five years, Warrington and Helen Grimes prepared for trial, including pretrial depositions, also called discovery.”

The Dr. and his wife were preparing, not a lawyer.

Ok, you got me….Big Mike! :)

Ok, so then…they were both preparing without lawyers??? lol If I recall the article correctly, was there any mention of lawyers for them? Wouldn’t this be the duty of a lawyer and if neither one had a lawyer, then that’s their own stupidity. You can’t take on a case like this without representation on either side.
